The Process for Nullification

At the Nullification Rally this past weekend, State Representative Leo Berman pointed out the specific steps that our state will be required to pass a Nullification Law to stop Obamacare or any other un-Constitutional bill Congress may send our way.

The first step is to have the Governor call for a Special Session of the Texas Legislature. In that session, a Resolution will need to be introduced to both chambers spelling out the intent of the law. You have seen examples on my website and my team and I are working on such a resolution to cover all un-Constitutional bills right now.

This resolution will have to be passed by both the Senate and the House by 2/3 vote.  We have enough margins in the Senate, but things are close in the House. There have been House Democrats in Texas that have openly admired what the Obama Administration has done and could pose problems. That being said, I do believe the current environment would get the resolution passed in both chambers.

Once the resolution passes both Chambers, it then has to be set on the ballot for election as an Amendment to the State of Texas Constitution. This is where we the people weigh in and make the idea a reality.

So as you can see, this is not a quick process. The sooner we can start the better.
